Land use planning is a means of ensuring that land and resources are managed and that growth occurs in a manner in which the community desires. Planning guides development while guarding against negative impacts.

The Planning Department is responsible for the overall planning and policy direction for land development in the Township, which includes Official Plan and Zoning By-law administration, review and process of development applications, and administration and recommendation​s for Council and the Committee of Adjustment. 

The Government of Ontario sets the ground rules and directions for land use planning through the Planning Act and Provincial Policy Statement. The Official Plan and Zoning By-law are daily tools that the municipality uses to implement its land use planning goals and outline specific conditions and requirements for development.

Projects that alter a property near any waterbody, wetland, steep slope or floodplain may require a permit under Ontario Regulation 41/24: Prohibited Activities, Exemptions and Permits (O. Reg 41/24). Please check with the applicable Conservation Authority to confirm whether additional permitting/approvals are required for your proposal.

An entrance permit is required for new entrances on roads under municipal jurisdiction. Please note, if your property is located on a County Road, the United Counties of Leeds and Grenville is the approval authority for a new entrance.

Projects on lands within 800m of Highway 401 are within MTO’s area of control and may require Ministry approvals and permits prior to the construction and/or alteration of any buildings and/or structures and prior to the issuance of a municipal building permit or approval. Please be advised that all Land Development Pre-Consultation requests for Ministry review should be submitted to the Ministry of Transportation through the Highway Corridor Management Online portal.

Planning FAQs

The following Frequently Asked Questions (FAQs) are designed to provide clear and helpful information about the services and processes offered by the Planning Department. The Zoning By-law provides designations ("zones") that outline:

  • Permitted Uses in the Zone, which lists how the lands can be used and provides definitions related to these uses.
  • Zone Requirements, which outlines minimum lot size, frontage and setbacks from front, rear and side lot lines and prescribes maximum heights permitted and the extent to which lot can be developed.
  • General Provisions and Definitions, which outline numerous other requirements for matters such as parking area regulations, driveway, setback to lot lines, driveway widths, home based business rules, etc.

Map It GIS is a mapping application provided by the United Counties of Leeds and Grenville in partnership with Elizabethtown-Kitley. This mapping application provides access to an active map of the Township and will show current planning applications as well as planning information which includes Zoning By-law Schedule layers and Official Plan Schedule layers that can be used to help determine the zoning and designation of your property. A second dwelling or a second dwelling unit are permitted on the same lot where a single dwelling, semi-detached dwelling, or a townhouse dwelling is a permitted use in a zone. Section 3.21 of the Zoning By-Law includes the requirements that a second dwelling and second dwelling unit must meet.  

Prior to a building permit application for a second dwelling or second dwelling unit it is always best to consult with the Planning Department to confirm the proposal is in compliance with the applicable second dwelling or second dwelling unit requirements.

The Counties of Leeds and Grenville is the Consent Granting Authority for all consent applications in the Township, however preliminary consultation with the municipality is the first step. A preliminary severance inquiry can be made through the online form on the Planning/Preliminary Inquiries page. A sketch is required to be submitted with the form, detailing the proposed lot size and configuration, road frontage and any existing/proposed building (if any). Please also be sure to make note of any existing livestock facilities within 1500m of the subject property.

A site plan is a sketch of the property that shows the location of your project and how close it is to the property lines. A site plan generally should include the following:

  • Dimensions and area of the lot and address and/or legal description, North arrow
  • Location of existing and proposed easements
  • Location of road boundaries, private lane or public road, and dimensions
  • Location, dimension and area of building in relation to the building lot
  • Setbacks/distances between each building, property lines, sewage system and septic tank
  • Location of streams, waterbodies, ditches and substantial differences in grade on land
  • Location of any overhead power lines, location of driveway

A tiny house is permitted as a dwelling in all zones where a residential use is a permitted principal use, except in the Estate Residential (RE) Zone, provided that the applicant shall obtain a sewage system approval and that the tiny house meets all of the zone standards of the applicable zone and all provisions of the Ontario Building Code.

A mobile home however, is not permitted within the Township unless they are located in the Mobile Home Park Residential (RMH) zone. It is important to ensure that the proposed home is classified as a tiny house rather than a mobile home under the Ontario Building Code.

Zoning compliance requests are to be submitted through a lawyer's office. The fee for written confirmation of Zoning is $100.00 and the fee for building work orders search is $75.00. Additional fees may apply if further information is requested. Please refer to the Planning Fees page for a complete list of fees.

The typical turnaround time for this service is 10 business days from the receipt of payment, depending on staffing levels and volume of work.

Whether your project requires a permit or not, development must comply with all applicable requirements of the Zoning By-law. Please be sure to consult with the Planning Department for information about zoning and setback requirements applicable to your development proposal.

The Township does not license commercial businesses except for Mobile Food Truck Licenses. However, commercial businesses must be a use that is permitted in the Zone of the subject property. The Zoning By-Law does include a section permitting Home-Based Businesses such as day cares, professional offices, studios of crafts persons, instruction of students, etc. Section 3.9 of the Zoning By-Law includes the standards by which a Home-Based Businesses is required to operate.

Prior to proceeding with any type of business it is always best to consult with the Planning Department to confirm the proposal is in compliance with applicable planning requirements. 

To obtain a Civic/911 number, an approved Entrance Permit is required.

To apply for an entrance permit for road/highways under municipal jurisdiction please fill out the Township’s Entrance Permit Application.

Please note, if your property is located on a County Road, the United Counties of Leeds and Grenville is the approval authority for a new entrance. For entrances on County Road, you must provide the Township with a copy of the approved entrance permit to obtain a Civic/911 number.
