NOTICE OF PUBLIC MEETING
TOWNSHIP OF ELIZABETHTOWN-KITLEY
CONCERNING PROPOSED OFFICIAL PLAN AMENDMENT No. 6
and
A ZONING BY-LAW AMENDMENT TO ZONING BY-LAW 13-21, AS AMENDED
Part of Lots 20 and 21, Conc 4 (Geographic Twp of Elizabethtown)
Southeast Intersection of Woods Road and County Road 29 – Spring Valley

 

YOU HAVE BEEN CIRCULATED THIS NOTICE as you are either a property owner within 120 m (400 ft.) of the property which is the subject of these Official Plan and Zoning By-law Amendment applications or you are a prescribed person or public body to be circulated under O.Reg. 543/06 and 545/06, the Planning Act, R.S.O. 1990.

TAKE NOTICE that applications to amend the Official Plan and Zoning By-law have been received in relation to the above-noted lands and the Council of the Corporation of the Township of Elizabethtown-Kitley will hold a Public Meeting on Monday, May 13, 2024, at 6:00 p.m. in the Council Chambers at the Municipal Office located at 6544 New Dublin Road in New Dublin as well as via Council’s virtual zoom meeting process to consider the following applications:

• Purpose and Effect – A proposed site-specific Official Plan amendment to the Township Official Plan under the Planning Act, R.S.O., 1990, Chapter P.13, Section 22. The lands subject to the Official Plan amendment are 5.3 ha (13 ac) in area and are currently designated Rural in the Official Plan. The proponents have applied to redesignate the lands to a Rural Exception designation to permit the development of a contractor’s yard/shop and office and a heated and unheated storage facility. The office portion of the building is to include two residential units on the second storey. The Rural designation does permit a contractor’s yard or shop and a storage facility, however, there is a provision that limits the area of a building(s) to 465 square metres (5,000 square feet) and an exception designation is needed for the area of the proposed buildings for a contractor’s yard/shop/office and for the proposed storage facility.

• Purpose and Effect – A proposed site-specific Zoning By-law amendment to Zoning By-law No. 13-21, under the Planning Act, R.S.O., 1990, Chapter P.13, Section 34.

• To rezone the 5.3 ha (13ac) that are to be redesignated from Rural (RU) to Rural – Exception – Holding to permit the development of a contractor’s yard/shop and office and a heated and unheated storage facility. The office portion is to have two residential units on the second storey. A contractor’s yard and a storage facility are permitted in the industrial zone, however, the maximum floor area is 465 square metres (5,000 square feet) and an exception zone is needed for the floor area of the buildings to be constructed on the site.

• To rezone the adjoining lands (approximately 5 ha or 12 ac) that are to remain designated Settlement Area by the Official Plan from Rural – Exception 2 to General Commercial – Exception – Holding to permit the general commercial uses of the CG zone (including a garden/landscape depot) and accessory residential units above commercial buildings.

• Once the Official Plan and zoning amendments are approved, no building permits may be issued until the h-holding symbols are removed by Council. The approval of a site plan and a storm water management and lot grading and drainage plan and a traffic study will be required prior to the removal of the h-holding symbol.

THE SUBJECT LANDS are not the subject of any other planning applications in accordance with O.Reg 543/06 and O.Reg 545/06.

IF you wish to be notified of the decision on the proposed amendments by the Township of Elizabethtown-Kitley you must make a written request for such notice to the Clerk, at the address below.

IF a person or public body would otherwise have an ability to appeal the decision of the Township of Elizabethtown-Kitley to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Elizabethtown-Kitley before the proposed Official Plan amendment is adopted and/or the Zoning By-law amendment is passed, the person or public body is not entitled to appeal the decision.

IF a person of public body does not make oral submissions at a public meeting or make written submissions to the Township of Elizabethtown-Kitley before the Official Plan amendment is adopted and/or the Zoning By-law amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
