NOTICE OF PUBLIC MEETING

TOWNSHIP OF ELIZABETHTOWN-KITLEY
CONCERNING A PROPOSED ZONING BY-LAW AMENDMENT (Z-04-23) TO ZONING BY-LAW 13-21, AS AMENDED CONDITION OF SEVERANCE APPLICATION B-51-23
Con. 9, Pt. Lot 34, 9210 Addison Greenbush Rd (Geographic Elizabethtown)

TAKE NOTICE that an application to amend the Zoning By-law has been received in relation to the above-noted lands and the Council of the Corporation of the Township of Elizabethtown-Kitley will hold a Public Meeting on Monday, January 29, 2024 at 7:00 p.m. in the Council Chambers at the Municipal Office located at 6544 New Dublin Road in New Dublin as well as via Council’s virtual zoom meeting process to consider the following application for approximately 0.57 ha (1.41 ac) of land situated in Part of Lot 34, Concession 9, Geographic Elizabethtown and located at 9210 Addison Greenbush Rd:

A proposed site-specific Zoning By-law amendment to Zoning By-law No. 13-21, under the Planning Act, R.S.O., 1990, Chapter P.13, Section 34 for approximately 0.57 ha (1.41ac) of land situated on Part of Lot 34, Concession 9 (Elizabethtown) to be the severed and retained lands under severance application B-51-23, 9210 Addison Greenbush Rd. The purpose of the zoning amendment is to change the split zoning of the property from Rural Special Exception 2 (RU-2) and Residential Type 1 (R1) by placing the severed and retained parcels into separate Residential Type 1 -Special Exception zones (R1-6 & R1-7). The effect of the amendment would be to allow for the undersized lot areas of 0.25 ha (0.63ac) for the severed lands and 0.32 ha (0.78ac) for the retained lands, and frontages of 42.5m for both the severed and retained lands, as a result of consent application B-51-23.

THE SUBJECT LANDS are subject to Consent Application B-51-23 under the Planning Act and the Consent Granting Authority of the United Counties of Leeds and Grenville has approved the application subject to a number of conditions, including the proposed rezoning of the subject lands to Residential Type 1 Special Exception Zone ..

ANY PERSON INTERESTED in speaking to the proposed amendment may do so by contacting the Deputy Clerk via email to deputyclerk@ektwp.ca to arrange for an opportunity to address Council. A request to speak in-person or virtually at the meeting must be made by noon on January 29, 2024.

Anyone interested in making written representations to Council on the proposed amendment should submit written comments to the Main Municipal Office, 6544 New Dublin Road, R.R. #2, Addison, ON KOE 1A0 or via email to deputyclerk@ektwp.ca by noon on January 29, 2024, so the comments can be relayed at the public meeting.

IF a person or public body would otherwise have an ability to appeal the decision of the Township of Elizabethtown-Kitley to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Elizabethtown-Kitley before the proposed Zoning By-law amendment is passed, the person or public body is not entitled to appeal the decision.

IF a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Elizabethtown-Kitley before the Zoning By-law amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
